1. Acceptance of Terms

By creating an account, signing in, or using Hush ("the Service," "we," "us," or "our") you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. These Terms form a binding agreement between you and Hush AI.

2. Eligibility (18+ Only)

Hush is intended exclusively for users who are 18 years of age or older. By using the Service you represent and warrant that you are at least 18, that you have the legal capacity to enter into these Terms, and that your use of the Service does not violate any law in your jurisdiction. We reserve the right to terminate any account we believe is held by a minor and to delete the associated data.

3. Description of Service

Hush is an AI companion platform that lets you create personalized AI personas with custom voices, images, videos, and real-time phone line capabilities. Features include text chat, voice chat, AI image and video generation, voice cloning, AI-initiated phone calls, and SMS messaging from your AI companion. The Service is provided "as is" and may evolve, change, or be discontinued at any time at our sole discretion.

4. Account & Your Responsibilities

• You are responsible for safeguarding your account credentials and for all activity that occurs under your account.
• You agree to provide accurate information and to keep it current.
• You may not share your account, sublicense it, or use it on behalf of another person without our written consent.
• You are solely responsible for any phone numbers, photos, recordings, or other content you upload or otherwise provide to the Service.

5. AI-Generated Content Disclaimer

Hush uses third-party AI models (xAI Grok, OpenAI, ElevenLabs, Fal.ai, HeyGen, and others) to generate text, voice, images, and videos. AI output:

• Is generated automatically and may be inaccurate, offensive, or unexpected.
• Is not a substitute for professional advice (medical, legal, financial, mental-health, or otherwise).
• Does not represent the views or opinions of Hush AI or any third-party model provider.
• May produce content that resembles real people; you are responsible for ensuring you have any rights and consents required to upload reference photos or audio.

You use AI-generated content at your own risk. We disclaim all liability for actions you take in reliance on AI output.

6. Paid Services & Token Economy

• Some features require a paid subscription or token purchase. Pricing is shown in-app and may change with notice.
• Payments are processed by Stripe (web) or Apple In-App Purchase (iOS). We do not store payment-card data.
• Tokens are a virtual in-app currency with no monetary value outside the Service. Tokens are non-refundable, non-transferable, and have no cash redemption value.
• Subscriptions auto-renew unless cancelled before the next billing cycle. You can cancel at any time through your account settings or your platform store (Stripe portal or App Store).
• Refunds are issued at our discretion and in accordance with applicable law and Apple's App Store policies.

8. Acceptable Use

You agree NOT to use Hush to:

• Generate, request, or distribute content sexualizing or depicting minors in any way.
• Impersonate any real person without their explicit consent, or upload another person's likeness or voice without authorization.
• Generate non-consensual intimate imagery, deepfakes used for harassment, or content intended to defame, threaten, or harass any individual.
• Engage in spam, phishing, or unsolicited marketing via the SMS or phone-call features.
• Violate any applicable law, regulation, or third-party right.
• Attempt to reverse-engineer, scrape, or interfere with the operation of the Service.
• Use the Service to develop a competing product.

Violations may result in immediate account termination, removal of content, forfeiture of unused tokens or paid subscriptions, and reporting to law enforcement where appropriate.

9. User Content & License

You retain ownership of the photos, voice recordings, prompts, and other content you upload ("User Content"). By uploading User Content, you grant Hush a worldwide, non-exclusive, royalty-free license to host, store, process, transmit, and display that content as necessary to operate the Service for you (including transmitting it to the third-party AI providers listed in our Privacy Policy). This license ends when you delete the content or your account, except where retention is required by law.

10. Intellectual Property

All software, designs, trademarks, and other materials provided by Hush are the property of Hush AI or its licensors. You receive a limited, revocable, non-transferable license to use the Service for personal, non-commercial purposes only. You may not copy, modify, distribute, sell, or lease any part of the Service.

11. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT AI-GENERATED CONTENT WILL BE ACCURATE OR APPROPRIATE.

12. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, HUSH AI AND ITS AFFILIATES, OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID HUSH AI IN THE 12 MONTHS BEFORE THE CLAIM AROSE OR (B) USD $50.

13. Indemnification

You agree to indemnify, defend, and hold harmless Hush AI from any claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) your use of the Service; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third-party right, including any intellectual-property or privacy right.

14. Termination

You may stop using the Service and delete your account at any time. We may suspend or terminate your account at our sole discretion, with or without notice, for any violation of these Terms or for any other reason. Upon termination, your right to use the Service ceases immediately; provisions of these Terms that by their nature should survive (including disclaimers, limitations of liability, and dispute provisions) will survive.

15. Governing Law & Disputes

These Terms are governed by the laws of the State of Florida, USA, without regard to its conflict-of-laws principles. Any dispute arising out of or relating to these Terms or the Service will be resolved exclusively in the state or federal courts located in Miami-Dade County, Florida, and you consent to the personal jurisdiction of those courts. You and Hush AI each waive any right to a trial by jury.

16. Apple App Store EULA Addendum

If you access Hush through Apple's App Store, you acknowledge that these Terms are between you and Hush AI only, not Apple, and Apple is not responsible for the Service or its content. Apple has no obligation to provide maintenance or support. In the event of a failure of the Service to conform to any applicable warranty, you may notify Apple, who will refund the purchase price (if any). To the maximum extent permitted by law, Apple has no other warranty obligation. Apple is a third-party beneficiary of these Terms and may enforce them against you.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be posted with an updated effective date and, where reasonably practical, communicated in-app. Your continued use of the Service after changes take effect constitutes your acceptance of the updated Terms.
